Rebecca Kirk wasn't in Pike County Court Tuesday for her scheduled hearing.
Her attorney, John Morthland, was.
Like every court docket Kirk has been listed on throughout the proceedings of her evidence tampering charges, this was a short discussion with the judge.
Morthland officially handed Judge Chris Kunza Mennemeyer a request to change judges in Kirk's case and after a brief chat, Morthland's work is complete.
According to Mark Fisher, the Pike County prosecutor, said Mennemeyer will more than likely send Kirk's request through the Missouri Supreme Court and then those judges will assign the new judge. Fisher added the Missouri Supreme Court can appoint any judge to Kirk's case, but more than likely one of the associate circuit judges out of the 45 Judicial Circuit in Lincoln County.
Those two judges are James Beck and T. Bennett Burkemper, Jr.
As to which judge he prefers to have in the case, Morthland smirked and said, "I can't tell you that."
Kirk is expected to be in court June 25 for her pre-trial conference. As to which judge she'll be appearing in front of, it's not clear as to when that decsion will be made.
