  • In just a little over a month, a jury could decide Jason Birdno's fate.
    The 36-year-old Monroe City man is charged with five counts of first degree statutory stodomy with a person less than 14-years-old. Two of the charges date back to 2006. He has been in Monroe County custody since April 2012.
    A trial is now scheudled for Feb. 20-22 with hearing Feb. 4 at the Audrain County Courthouse in Mexico, Mo. The case was moved out of Monroe County on a change of venue request. Monroe County Prosecutor Talley Kendrick remains the lead state attorney on the case while Birdno has hired his own attorney.
    Public Defender David Clayton was assigned to Birdno and was representing him throughout the case, but now that Gillis Leonard of Moberly is representing Birdno, Clayton withdrew December 27.
    Birdno is being held on $150,000 cash only bond at the Monroe County Jail. Because his felonies are labeled unclassified, it is unknown the possible range of sentencing Birdno faces.
